The regular testing of portable equipment became a legal requirement in April 1990. Severe penalties can be imposed where portable appliances used in a place of business are not being tested. Failure to comply could mean a heavy fine and quite possibly a jail sentence.

Insurance Implications.

Most major underwriters have indicated that they expect the business they insure to be compliant with all applicable regulations when insuring the business. An insurer may reduce, delay or even refuse to pay on a claim for damage if an appliance that has not been tested has led or contributed to the damage.

ELECTRICITY CAN KILL!

Each year about 1000 accidents at work involving electric shock or burns are reported to the Health and Safety Executive. Around 30 of these are fatal.

The Health and Safety Executive states that 25% of all reportable electrical accidents involve portable appliances. The Electricity at Work Regulations place a legal responsibility on employers, employees and self employed persons to comply with the provisions of the regulations and take reasonable practicable steps to ensure that no danger results from the use of such equipment. This in effect requires the implementation of a systematic and regular program of maintenance, inspection and testing.

The Health & Safety at Work Act (1974) places such an obligation in the following circumstances:

Where portable appliances are used by employees.
Where the public may use appliances in establishments such as Hospitals, Schools, Hotels, Shops etc.
Where portable appliances are supplied or hired.
Where portable appliances are repaired or serviced.


A sobering fact:-

Portable electrical appliances are a major cause of fires both in the workplace and at home. Over 2,500 people are killed or injured as a result of electrical fires every year!
